3. That on or around [DATE], the Applicant discovered that the said bank account had been debit-frozen / placed under lien based on instructions received from the Respondent Police Station (Refer Annexure A).
4. That the Applicant states that they are a bona fide user of the account and have no connection to any alleged fraudulent activity. The banking transactions reflect a normal course of business/savings (Refer Annexure C).
5. GROUNDS FOR RETURN: That the Applicant requires the immediate use of funds for [REASON]. Following the principles laid down by the Hon’ble Supreme Court regarding the return of movable property during the pendency of trial, no useful purpose is served by keeping the liquid assets frozen indefinitely (Refer Annexure D).
6. UNDERTAKING: The Applicant is willing to abide by any condition imposed by this Hon’ble Court, including furnishing an Indemnity Bond. The Applicant undertakes to produce the equivalent amount if directed by the Hon’ble Court during the trial.
PRAYER:
The Applicant, therefore, prays that:
- This Hon’ble Court be pleased to call for the report from the [PS] Police Station regarding the status of the frozen account.
- This Hon’ble Court be pleased to direct the Branch Manager of [BANK] to de-freeze Account No. [ACC NO] and allow the Applicant to operate the same.
- Such other and further orders as this Hon’ble Court may deem fit and proper in the interest of justice.
