- The 2023 Telecommunications Act has brought about significant changes to India’s telecom laws, particularly in relation to messaging services like WhatsApp. One of the key points is the introduction of licensing requirements for internet-based calling and messaging services. This means that users may now need to undergo a know your customer (KYC) process in order to send messages on WhatsApp, ensuring a higher level of security and accountability.
- Another important change is the introduction of chat interoperability, which allows WhatsApp users to enable or disable the feature, aligning with Article 7 of the regulations. This means that users will now have the ability to communicate across different messaging platforms, providing greater flexibility and convenience.
- Additionally, the Act has increased the SIM card limit, allowing individuals to have up to nine SIM cards registered in their name. However, residents of Jammu and Kashmir and the northeast may have a lower limit due to regional regulations. This change aims to provide greater accessibility and flexibility for users, while still adhering to regional regulations.
- The Act also addresses the issue of unsolicited commercial messages, imposing fines of up to Rs 2 lakh and potential service bans for operators who send such messages without user consent. This is a significant step towards protecting users from unwanted spam and ensuring a more positive messaging experience.
- Furthermore, the Act streamlines the process for telecom companies to expand their infrastructure, such as installing mobile towers or laying telecom cables on private property. This will lead to improved connectivity and better access to telecommunication services for the people of India.
- It’s important to note that the Telecommunications Act grants the government the authority to take over control and management of telecommunication services or networks in the interest of national security, public safety, friendly relations with foreign states, or for India’s sovereignty and integrity. This provision ensures that the government can act swiftly and decisively in times of need to protect the country’s interests.
Chat across different platforms with ease! Thanks to the 2023 Telecommunications Act, WhatsApp users in India can now enjoy chat interoperability. Stay connected like never before!
