Mumbai High Court Bail Granted: A Case Study of Ellena Kasakatira

The Bombay High Court has approved bail for Ellena Kasakatira, a foreign national implicated in a case concerning the possession of a significant quantity of cocaine.

Ellena was taken into custody on November 23, 2020, at Mumbai International Airport after authorities acted on a tip-off. Although a personal search did not reveal any illicit substances, investigators discovered approximately 1,000 grams of cocaine concealed in two packets within a blue trolley belonging to her.

In her defense, Ellena’s attorney pointed out that she did not provide her signature on the panchanama, the official seizure document prepared at the airport. The High Court acknowledged that this lack of signature could weaken the prosecution’s argument against her.

The court further noted that while Ellena had signed a notice under Section 50 of the NDPS Act, her signature was notably missing from the panchanama created at the airport on the same day of her arrest.

Taking into account that Ellena had no previous criminal history and had spent four years in detention, the court decided to grant her bail, stipulating a cash bond of Rs 1 lakh as a condition for her release.
